I have over 35 years' experience of construction and engineering law in connection with projects (private, public sector and privatisation) in Hong Kong and in almost all countries in the Asia Pacific region. My practise primarily involves arbitration of construction disputes, having been involved in over 250 cases, often as advocate. However he deals with both contentious and non-contentious matters and is Legal Advisor to the Hong Kong Construction Association.
I have regularly advised a wide range of clients and industry participants from the public and private sectors and is experienced in all forms of dispute resolution including court, arbitration, mediation and adjudication including having acted as adjudicator in a number of disputes arising out of the construction of the Hong Kong International Airport. I have advised the Hong Kong Government on implementation of past legislation and was one of the drafters of the Arbitration Ordinance Cap 609.
I have also been advisor to the Hong Kong Construction Association (“HKCA”) for 30 years and as such has been instrumental in the lobbying of law reform in Hong Kong, in particular I were involved in drafting the Hong Kong Arbitration Ordinance that was enacted in 2011 and were recently involved in helping to redraft the Domestic Arbitration Rules of the HKIAC. I have also lobbied the Hong Kong Government for many years to enact security of payment legislation and is now involved in helping with the drafting of that legislation.
I am also a qualified arbitrator and mediator, a member of Hong Kong International Arbitration Centre Panel of Mediators and List of Arbitrators and a member of Chartered Institute of Arbitrators (Hong Kong Branch) Panel of Arbitrators.
Experience
Projects and Non-Contentious Experience
Design, Build and Operate and Concession Projects
· Advised the Hong Kong Football Club in respect of the redevelopment of Happy Valley, an undertaking with the Royal Hong Kong Jockey Club; including drafting of development agreement, operation agreement, contractor's warranty and various ancillary agreements and advising on the terms of various land swap agreements
· Advised the Franchise Holder of the Concession to build and operate the new Hong Kong Airport Hotel, including advising on lease, construction and operation agreements
· Drafted documentation for Tate's Cairn Tunnel BOT project including Turnkey Contract, major sub-contracts (including E & M) including preparation of tender packages, Design Consultant’s Agreement, Independent Checking and Site Engineer's Agreement and various performance bonds and guarantees. Liaised with Tunnel Company's advisers on negotiations with Government and assisted in the drafting of the governing Ordinance and BOT Contract. Also advised on matters arising during the course of construction
· Conducted negotiations with Government in respect of the drafting of the DBO Contract for Kowloon Bay Waste Transfer Station on behalf of the Contractor/Operator. Drafted major sub-contract for project as well as Design Consultant’s Agreement and Independent Checking Engineer's Agreement
· Advised the Hong Kong Government on the framework and structuring of the contracts required for the design, build, finance, operation and aftercare of Hong Kong's strategic landfills including the Drafting of Conditions of Contract, performance bonds and guarantees, and Independent Consultants Agreement for the standard form DBO Contract for New Territories Strategic Landfills (Core Consultancy). Also advised on the regulatory framework required for the introduction of direct charging in respect of the use of the facility
· Drafted Special Conditions and one of multi-disciplinary team advising the Hong Kong Government which drafted the Tender package for the SENT Landfill DBO Contract. Assisting in the evaluation of the tenders for the project
· Advised the Hong Kong Government in the preparation of separate DBO tender documentation packages for refuse transfer stations in Hong Kong at Island West, West Kowloon and Outlying Islands
· Advised the Hong Kong Government in connection with Hong Kong's first Special Waste Incineration Facility including advising on the structure of this DBO contract and the legal framework for the introduction of direct charging in respect of the use of the facility, drafting the DBO contract and assisting the multidisciplinary team with the tender preparation
· Advised the Franchise holder on the documentation for the Second crossing BOT project in Malaysia/Singapore, including advising on the terms of the Concession Agreement, Inter Government Treaty between Governments of Malaysia and Singapore and drafting necessary construction contracts and consultancy agreements
· Advised the Hong Kong Government in connection with Hong Kong's first Low Level Radioactive Waste Storage Facility including advising on the structure and framework of this DBO contract drafted the DBO contract and assisting the multidisciplinary team with the tender preparation
· Advised Kuala Lumpur International Airport Berhad on the structure and documentation for Kuala Lumpur's new international airport including necessary construction contracts and consultancy agreements. Also assisted in the preparation of Invitation for Proposals for BOT cogeneration plant for supply of chilled water to the airport and drafted concession agreement
· Advised the Hong Kong Government on legal issues arising as part of a study to review the operation of DBO entered into by the Environmental Protection Department in previous 15 years and suggest future strategy for the next generation of DBO contracts.
· Advising PRC contractor on concession for alumina project in Guinea
· Advising Governments of Hong Kong, Guangdong and Macau on structuring and implementation of the Hong Kong-Zhuhai-Macau Bridge, an iconic 50 kilometre bridge and tunnel structure. Advised on and drafted project and inter government agreements
Building, Civil Engineering and Design and Build Contracts
· Advised Hong Kong developer on construction of a large commercial development in Nathan Road including review and drafting of construction contracts and consultancy agreements
· Advised the Kowloon Canton Railway Corporation in relation to all construction contracts, joint venture agreements and all ancillary documentation for the Ho Tung Lau joint development
· Drafted main contract, sub-contract and various bonds and guarantees for construction of Hong Kong Park
· Advised HKCA and tenderers in their negotiations with the Provisional Airport Authority over the tender documentation for Hong Kong International Airport
· Advised the Hong Kong Association of Consulting Engineers in its negotiations with the Provisional Airport Authority over the tender documentation for engineering consultancies for Hong Kong International Airport
· Advised tenderer on bid for E & M works for passenger terminal building at new airport in Hong Kong
· Advised tenderer on bid for luggage handling contract for passenger terminal building at new airport in Hong Kong
· Advised large electrical utility in Hong Kong in drafting standard form Building and Civil Engineering forms of Contract
· Advised a number of contractors on conditions of contract for hotels, commercial and residential developments in Hong Kong and the region
· Advised contractor on construction of factory in China, including drafting building contract
· Advised the Hong Kong Football Club in respect of the replacement of the club pitch on three occasions
· Drafted the design and build contract for the second airport hotel at the New Hong Kong International Airport
· Drafted joint venture agreements in connection with Turnkey Contract for waste water treatment plant in Thailand

· Advised Hong Kong Government and assisted in the preparation of the regulatory framework and legislation for the implementation of a trade effluent surcharge
· Advised HKCA on Hong Kong Arbitration Ordinance, representing HKCA on Department of Justice committee and drafting sub-committee. One of three drafters of Arbitration Ordinance Cap. 609

Advisory And Dispute Resolution
· Extensive experience in dispute resolution in the building, construction and engineering industries, in excess of 250 cases. High Court proceedings to the House of Lords and Court of Final Appeal; cases involving breach of contract and negligence, numerous arbitration proceedings as representative and advocate to final hearing again involving contract and negligence claims. Appointments as adjudicator in disputes concerning Hong Kong International Airport. Involvement in about thirty mediations, most of them large ones and two of which involved claims against engineers for professional negligence
Tunnels
· Advised main contractor joint venture on contract issues for design and construction of the BOT contracts for Tate's Cairn Tunnel, Western Harbour Crossing and Eastern Harbour Crossing, all in Hong Kong
· Advising Hong Kong Harbour Tunnel Company on various issues arising out of defects appearing during operation of the tunnel.
· Advising Eastern Harbour Crossing Company on numerous issues arising during its concession period
· Acting for developer of Housing Project in claim under Sewage Tunnel Ordinance for compensation arising out damage to development caused by tunnel works
· Acting for the international joint venture contractor in arbitration proceedings against the Government arising out of the termination of a sewage scheme cross harbour bored tunnel contract (Claim of HK$1.5 billion)
· Advising international JV contractor on issues arising out of construction of Hong Kong West Drainage Tunnel.
· Advising international contractor on claims arising out of contract for Tsuen Wan Drainage Tunnel
Airports
· Acting for international JV contractor building the terminal building for Hong Kong International Airport, having an advisory role from pre-tender to completion of the building and thereafter in major arbitration and mediation proceedings against the Airport Authority, leading a team of six lawyers (Contract value HK$12 billion, claim in excess of HK$1 billion)
· Advising the contractor who constructed the HK$10 billion reclamation for the Hong Kong International Airport, during the course of construction
· Acting for runway light system contractor in major High Court proceedings brought by sub-contractor
· Advising contractor in arbitration proceedings on contract for airfield tunnels, including High Court proceedings for enforcement of Dispute Review Panel decision
Buildings
· Advised during the construction of Pacific Place II in Hong Kong as well as drafted supplemental documentation to the Main Contract.
· Advised the main contractor on issues arising out of the construction of world's then tallest building in Taipei
· Acting for a sub-contractor in arbitration proceedings against the contractor arising out of the construction of the wave pool at Ocean Park
· Acting for insurers of Employer against engineering/architectural consultants in High Court proceedings for professional negligence arising out of the design of a plant room in a major residential development in Aberdeen, Hong Kong
· Acting for the Bank of East Asia in the Landmark case against a contractor and professional advisers for negligence in the design and construction of cladding on the bank building (Claim of HK$50 million). Acting in the High Court, Court of Appeal and Court of Final Appeal. The case was a Landmark decision for Hong Kong on the question of limitation of proceedings
· Acting for engineering consultants in defending arbitration proceedings brought by an Employer in respect of the design and supervision of a newspaper printing facility and subsequently in appeal proceedings in the High Court
· Acting for international contractor in ICC Arbitration Proceedings arising out of the termination of a contract (FIDIC) for a Shanghai Golf and Country Resort Development (Claim of US$40 million)
· Acting for international contractor in mediation proceedings for claims for extensions of time and loss and expense arising out of the construction of Cathay City, the headquarters of Cathay Pacific Airways (Claim of HK$150 million)
· Acting for Hong Kong developer in arbitration proceedings against contractor in respect of claims for extensions of time and loss and expense arising out of a large high-rise development

· Advising international contractor during the construction of a major road contract forming part of the Hong Kong International Airport. Acting for the contractor in arbitration and mediation proceedings against the Government and subsequently appeal proceedings in the High Court (Contractor's claims in excess of HK$100 million)
· Acting for international contractor in mediation/adjudication proceedings against the Government arising out of suspension of major road widening design and build project due to dangers which were claimed to be impossible to overcome. Also acting for the same contractor in arbitration proceedings against its engineering consultants for professional negligence arising out of separate issues
· Acting for international contractor constructing one of the largest cable stayed bridges under a design and build contract, the Ting Kau Bridge, during the course of construction and in two sets of mediation proceedings against the Government for claims for extensions of time and loss and expense (Claims in excess of HK$300 million). Also acting for the contractor in mediation proceedings against its engineering consultants in respect of claims for professional negligence (Claims in excess of HK$100 million)
· Acting for engineering consultants in defending arbitration proceedings for professional negligence arising out of the design of the Kap Shui Mun Cable Stayed Bridge under a design and build contract (Claim of HK$350 million)
· Acting for sub-contractor in arbitration proceedings and subsequent appeal to High Court arising out of construction of foundations for bridge project spanning border of Hong Kong and China. This leave to appeal application from the arbitrator's award was the first successful one ever made in Hong Kong

· Advising engineering consultants on claims for professional negligence brought by design and build contractors on the Singapore MRT Project
· Acting for international contractor in claims and arbitration against MTRC in respect of West Kowloon Station, forming part of the new airport railway

· Advising international contractor on issues arising out of tunnel renovation contract for MRT system

· Acting for international contractor on on MTRC’s High Speed Rail Project in respect of major diaphragm wall sub-contract arbitrations, leading a team of 12 lawyers in three inter related arbitrations for two sub-contracts, including appeal proceedings in Court of First Instance and Court of Appeal. One of the largest ever construction cases in Hong Kong

Leading a large team (Claims in excess of US$100 million)
· Acting for engineering consultancy in UNCITRAL arbitration in Thailand in defending proceedings for professional negligence arising out of design and suspension of construction of port facilities (Claim of HK$100 million)
· Acting for the contractor building the River Trade Terminal in Hong Kong during the course of construction and in respect of its claims for extensions of time and loss and expense
· Advising the steel-work contractor in respect of proceedings arising out of the failure of a steel bridge during construction of a port facility
· Advising engineering consultants in arbitration and mediation proceedings brought against it for professional negligence arising out of the design of a container facility (Claim of HK$100 million)
· Acting for M & E sub-contractors in High Court and arbitration proceedings arising out of a large port development in the PRC.
· Acting for the purchaser of an M & E Engineering Contractor in claims against the vendor for breach of warranty and misrepresentation
· Advising joint venture international contractor during the course of construction of the Central Reclamation including representation in mediation. Also acting for same contractor in sub-contract arbitrations
· Acting for PRC contractor in arbitration proceedings against the Government arising out of a river training contract claiming invalidity of liquidated damages provisions on basis of penalty (Claim of HK$17 million)
· Acting for Joint Venture developers in High Court proceedings against Government for breach of development agreement arising out of the construction of a new town in the New Territories. Leading large team in one of Hong Kong’s largest cases, where the hearing lasted in excess of one year and in subsequent court of Appeal proceedings (Claim of HK$2 billion)
